Terms of Service — Chat On Mars

1. Acceptance of these terms
By using Chat On Mars (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Service. Guests may use rooms without an account; using the Service as a guest also means you accept these Terms.
2. The service
Chat On Mars is a chat service that uses AI to translate messages in real time, so people who don't share a language can talk — each person reads and writes in their own language. We provide the Service as-is and may add, change, or remove features over time. There are two kinds of rooms: temporary (ephemeral) rooms that expire on their own, and persistent (venue) rooms that a host keeps and can reset.
3. Who may use it
You may use the Service only if you can form a binding agreement with us and are not barred from doing so under applicable law. You must be at least 13 years old to use the Service. If you are in the EU/EEA or another region with a higher digital-consent age, you must meet your local minimum age. If you use the Service on behalf of an organization (e.g. a venue), you represent that you're authorized to accept these Terms for it.
4. Accounts
An account is optional and is needed only to keep the rooms you own across devices. Keep your password secure; you are responsible for activity under your account. You may stop using your account at any time and may delete it, which removes your account data and the rooms you own (see the Privacy Policy).
5. Acceptable use
Use Chat On Mars lawfully and respectfully. You agree not to:
- harass, threaten, or abuse others;
- share content that is illegal, harmful, hateful, or sexually exploitative;
- infringe anyone's intellectual property or privacy rights;
- send spam, or attempt to disrupt, overload, or circumvent limits or security of the Service;
- use the Service to violate any applicable law.
We may remove content, reset or remove rooms, and suspend or end access that breaks these rules or that we reasonably believe is necessary to protect the Service or others.
6. Your content
You are responsible for the messages and other content you send. You retain ownership of your content. You grant us a limited license to host, transmit, translate (including via our third-party AI provider), cache, and display your content as needed to operate the Service. The person who creates a room can read its conversation and reset it; temporary rooms expire on their own, and venue rooms can be reset at any time. 7. AI translation and accuracy
Translations are produced by AI and may be imperfect, incomplete, or wrong. Do not rely on them for medical, legal, financial, safety, or other critical decisions. To translate a message, its text is sent to a third-party AI provider — see the Privacy Policy. You are responsible for verifying anything important through another means.
8. Third-party services
The Service depends on third-party providers (for AI translation, real-time delivery, hosting, and database storage). Their availability and terms are outside our control, and we aren't responsible for their acts or omissions.
9. Service availability and changes
The Service is provided as-is and as-available. We don't guarantee it will be uninterrupted, error-free, or that any room, message, or feature will remain available. We may modify, suspend, or discontinue any part of the Service at any time, including expiring or resetting rooms as described above.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy (including of translations), and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Chat On Mars and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from or related to your use of (or inability to use) the Service, including any reliance on translations. To the extent we are found liable, our total liability is limited to the amount you paid us to use the Service in the past 12 months, which, because the Service is provided free of charge, is $0. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Chat On Mars and its operator from claims arising out of your content, your use of the Service, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or to protect the Service or others. Sections that by their nature should survive termination (e.g. content license for already-processed content, disclaimers, liability limits, indemnification, and governing law) will survive.
14. Changes to these terms
We may update these Terms as the product evolves. We'll post the new effective date here and, for material changes, provide a more prominent notice. Continuing to use Chat On Mars after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Disputes will be brought in the courts located in British Columbia, Canada, unless applicable law gives you the right to bring them elsewhere.
